Call Team Processing Clause

Version 2026-10-25 · Effective from 25 October 2026

This English version is the governing text; the Czech version is a translation.

By accepting the collaboration in the Opener application, the call team (the “Processor”) enters into this data processing agreement under Art. 28 GDPR with the client that invited it to the collaboration (the “Controller”). The client enters into it by having set up the collaboration.

  1. Subject matter. The Processor contacts by telephone, on behalf of the Controller, the contacts that the Controller assigns to it in the application, records the results of calls and corrects contact details. It processes only the data that the application shows it for the assigned contacts, and only for the duration of the collaboration.

  2. Instructions. The Processor processes the data only on the Controller’s instructions (campaign, script, objective, collaboration settings) and for the Controller’s purpose. The Processor will not use the data for itself or for other clients, and will not copy it outside the application or download it unless the Controller expressly permits this.

  3. People. Only the Processor’s callers and leads who are bound by confidentiality have access. The Processor informs them that the application records their work (time and actions taken on contacts) and that the record is visible to both the Controller and the lead.

  4. Security. The Processor protects access to the application, does not share accounts and, without undue delay, removes access from anyone who stops working for it.

  5. Subprocessors. The Processor will not engage another processor without the Controller’s prior written consent. The operator of the Opener application is a processor of the Controller, not of the call team.

  6. Requests and incidents. If a contact, during a call, requests erasure, raises an objection or does not wish to be contacted, the Processor records this in the application (call result, “do not contact”) and does not contact that person again. The Processor notifies the Controller of any suspected security breach without undue delay, and in any event within 24 hours.

  7. End. When the collaboration ends or a contact is removed, the Processor loses access in accordance with the Controller’s settings and retains no copies.

  8. Information. The Processor provides the Controller with the information necessary to demonstrate compliance with this Clause.

Other matters between the Controller and the Processor (price, scope of work) are for the parties to agree between themselves.
